What Would W. Do? Nominate Garland, Says Former Bush Lawyer

President Obama's nomination of Judge Merrick Garland to the Supreme Court is putting pressure on Republican senators.

Republican Pennsylvania Senator Pat Toomey, who was elected during the tea party wave of 2010 said he will meet with Judge Garland, seen as a moderate jurist, "out of respect." Toomey is facing a tough reelection battle in his state.

Richard W. Painter, a professor of law at the University of Minnesota,worked in the George W. Bush Administration as the chief White House ethics lawyer from 2005 to 2007. 

Painter argues that, given the same opportunity during the end of his term, President Bush would've nominated "someone like Judge Merrick Garland" to the Supreme Court.
